Welcome to my sparkly little corner of the internet, where art meets attitude — and the fine print still matters. By browsing, buying, licensing, leasing, or simply admiring my work on this website ("the Site"), you agree to these Terms and Conditions ("Terms").

 

1. General Legal Provisions

• No Relationship: Nothing in this agreement creates any partnership, joint venture, agency, or employment relationship between you and Shari Pedowitz Artistic Empire, LLC. Your use of the Site is at your sole risk.

• Governing Law: These Terms are governed by the laws of New Jersey, USA. Any disputes will be resolved in the courts of New Jersey.

This is my artistic empire, not a playground for hackers, bots, or bad vibes.

 

4. Products, Purchases, and Final Sale Policy

We offer:

• Original art, prints, textiles, and gifts.

• Digital licenses (non-transferable unless agreed in writing).

• Art leasing.

• Custom commissions and creative services.

• Live painting and exhibition services.

All prices are in USD unless otherwise noted. Payments are processed securely via third-party platforms. You are responsible for any currency conversion or bank fees.

 

Final Sale Policy: Most items, especially original art, custom pieces, and digital files, are final sale. No returns, refunds, or exchanges will be offered unless an exception is clearly stated.

 

Resale Rights: All applicable resale fees and droit de suite laws (in the U.S. and internationally) apply to all purchases, including commissioned works, original art, and digital art.

 

5. Shipping and International Orders

We ship worldwide. You are responsible for any customs, duties, or import fees. While we pack everything with great care, we are not liable for delays, damage, loss, or theft caused by shipping carriers or customs officials once a package has left our hands.

 

6. Product Representation and Quality

We do our best to accurately represent the colors and textures of our artwork, but colors may vary depending on your screen. Each piece, especially original art, is one-of-a-kind and may have unique quirks or imperfections that are part of its character. If you are unsure about a piece, please ask before you buy. This site may be viewed in other languages via Google Translate, but the American English version is the official and most accurate. In the event of any discrepancies, the English version prevails.

 

7. Copyright and Intellectual Property

Everything you see on this Site — including art, text, product names, photos, brands, and brand/artist phrases — is owned by us unless otherwise credited. This includes all copyrights and trademarks.

• Unauthorized Use: Nothing on this Site may be reproduced, resold, printed, posted, shared, or merchandised without our explicit written permission.

• Licensing and Leasing: Any licenses or leases are always non-exclusive, non-transferable, and time-limited unless specified otherwise in a signed agreement.

 

8. Digital Content and Technology

• AI and Machine Learning: You may not use any of our work (in whole or in part) to train, inform, or generate content using artificial intelligence, machine learning, or similar tools.

• NFTs and Crypto: You may not tokenize, mint, distribute, or list our artwork — or anything resembling it — on any blockchain, NFT platform, or crypto-based marketplace.

Violation of these terms will be considered a legal violation and pursued accordingly.

 

9. Commissions and Services

If you commission us for a custom piece, event, or creative service:

• Copyright: We retain full copyright and trademark rights to the work unless otherwise negotiated in writing.

• Contract: Payment terms, timelines, and deliverables will be outlined in a separate contract.

• Payment: Custom and event-based work is non-refundable and may be subject to additional fees for travel or revisions.

• Exclusions: We do not work in unsafe environments, for poor lighting, or for "exposure."

 

10. Live Events and Personal Liability

If you attend a live painting, studio visit, or in-person event, you acknowledge that paint, glitter, sequins, or other materials may splatter. We are not liable for any damage to your clothing, shoes, devices, or personal property. Dress fabulously, but be aware of your surroundings.

 

11. Limitations of Liability

Art is meant to stir your soul, but your interpretation and emotional reaction are your own. We are not responsible for your emotional response, personal interpretations, or what others think of the piece. No refunds will be issued for emotional regret or confusion.

• Exclusive Remedy: If you are dissatisfied with the Site or these Terms, your sole and exclusive remedy is to stop using the Site.

• Limitation of Liability: To the fullest extent permitted by law, Shari Pedowitz Artistic Empire, LLC, and its members, employees, affiliates, and suppliers shall not be liable for any direct, indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from your use of the Site, its content, or products.
